1. Agreement to Terms
By accessing or using ContentCollective ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms constitute a legally binding agreement between you and ContentCollective.
2. Eligibility
- You must be at least 18 years of age to use ContentCollective
- You must have the legal capacity to enter into a binding agreement
- ContentCollective is invite-only; a valid invite code is required for registration
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the security of your account credentials
3. The Platform
ContentCollective is a professional network and resource platform for adult content creators, photographers, and creative professionals. The Platform provides:
- Educational resources and mentorship programs
- Community spaces for professional networking
- Business tools including cross-platform analytics
- A member directory and creator profiles
- Direct messaging between members
- Event coordination and collaboration tools
ContentCollective does not host, distribute, or sell explicit content. The Platform is a business and community infrastructure layer for creators who produce content on external platforms.
4. Account Responsibilities
4.1 Your Account
- You are responsible for all activity under your account
- You must not share your account credentials or invite codes with unauthorized parties
- You must notify us immediately of any unauthorized use of your account
- One account per person; duplicate accounts may be terminated
4.2 Profile Information
- Your display name and username are visible to other members
- Public creator profiles (if enabled) are visible on the open web
- You may use a stage name or pseudonym. Real legal names are not required for general use
- Profile content must not impersonate another person or entity
5. Community Standards
ContentCollective is a professional community. All members must:
5.1 Required Conduct
- Treat all members with respect and professionalism
- Respect boundaries and consent in all interactions
- Honor the confidentiality of private community discussions
- Report safety concerns or violations to the moderation team
5.2 Prohibited Conduct
- Harassment: Bullying, threats, intimidation, or unwanted sexual advances
- Doxxing: Sharing another member's real identity, address, or private information without consent. This is an immediate, permanent ban
- Discrimination: Hate speech or discrimination based on race, gender, sexuality, disability, religion, or any other protected characteristic
- Spam: Unsolicited promotional content, MLM/pyramid schemes, or mass messaging
- Fraud: Misrepresenting your identity, credentials, or services
- Platform abuse: Scraping data, reverse engineering, or exploiting security vulnerabilities
- Content violations: Uploading explicit sexual content to the Platform (the Platform is for business and community, not content hosting)
- Illegal activity: Using the Platform for any purpose that violates applicable law
5.3 Enforcement
Violations may result in:
- Warning and content removal
- Temporary suspension
- Permanent ban
- Reporting to law enforcement (for threats, CSAM, or other criminal activity)
Doxxing and credible threats result in immediate permanent bans with no appeal.
6. Intellectual Property
6.1 Your Content
You retain all rights to content you post on ContentCollective (messages, profile information, community posts, etc.). By posting content, you grant ContentCollective a limited, non-exclusive license to display and distribute that content within the Platform as necessary to provide our services.
6.2 Our Content
The Platform's design, code, educational materials (unless otherwise noted), logos, and branding are owned by ContentCollective. You may not reproduce, modify, or distribute our proprietary materials without written permission.
6.3 Educational Content
Courses and educational materials created by mentors remain the intellectual property of their creators. Enrollment grants you a personal, non-transferable license to access and learn from the material. You may not redistribute, resell, or share course content.
7. Mentorship and Education
- Mentorship relationships are peer-to-peer; ContentCollective facilitates connections but does not guarantee outcomes
- Mentors are independent contributors, not employees of ContentCollective
- Educational content is for informational purposes; it does not constitute professional legal, financial, or medical advice
- Course refund policies are set by individual mentors; ContentCollective's general refund policy applies where mentor policy is not specified
8. Platform Connections
ContentCollective allows you to connect external platforms (OnlyFans, Fansly, Instagram, etc.) for analytics and management purposes. By connecting a platform:
- You authorize ContentCollective to access the data you've granted permission for
- We store aggregated analytics data, not your platform login credentials
- You can disconnect a platform at any time through your settings
- We are not responsible for changes to external platform APIs or policies
9. Payments and Billing
- Membership fees are billed according to your selected plan
- Course purchases are one-time transactions unless otherwise stated
- Refunds for membership are available within 14 days of purchase for unused periods
- Payment processing is handled by third-party providers subject to their own terms
- All prices are in USD unless otherwise noted
10. Limitation of Liability
To the maximum extent permitted by law:
- ContentCollective is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
- We are not responsible for the actions, content, or conduct of other members
- We are not responsible for external platform policies, deplatforming events, or third-party service disruptions
11. Indemnification
You agree to indemnify and hold harmless ContentCollective, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.
12. Account Termination
12.1 By You
You may delete your account at any time through your account settings. Upon deletion, your data will be handled according to our Privacy Policy.
12.2 By Us
We may suspend or terminate your account for violations of these Terms, with or without notice depending on severity. We will provide an explanation unless doing so would compromise the safety of other members.
13. Dispute Resolution
- Disputes will first be addressed through good-faith negotiation
- If negotiation fails, disputes will be resolved through binding arbitration
- Arbitration will be conducted under the rules of the American Arbitration Association
- Class action waiver: disputes must be brought individually, not as part of a class action
- Small claims court remains available for qualifying disputes
14. Governing Law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.
15. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
